HUNTING/FISHING RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT.
Please read and be certain you understand the implications of signing. Express Assumption of Risk Associated with Hunting/Fishing and Related Activities I, do hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with hunting/fishing activities, transportation of equipment related to the activities, and traveling to and from activity sites in which I am about to engage. Inherent hazards and risks include but are not limited to:
1. Possible equipment failure and/or malfunction of my own or others’ equipment which may have been rented, borrowed or personally owned.
2. My own negligence and/or the negligence of others, including volunteers, agents, sponsors, independent contractors or representatives of Brothers-Sisters Of Our Military Adventures, Lake Meredith National Park Service (United States Of America), Randall County Sheriffs Association, and all those involved in the Big Bass & Heroes Tournament, including but not limited to operator error.
3. The hazards of being hooked, stabbed or any other kind of injury associated with fishing and fishing equipment not limited to being injured by wildlife, and those fishing in the same vessel.
4. Hazards related to fishing from a vessel and/or from other fishing sites which include but are not limited to: collision, capsizing, sinking, or other hazards that may result in wetness, injury, exposure to elements, hypothermia, impact of the body upon the water, injection of water into my body orifices, marine life forms, and/or drowning. These hazards include risk from other vessels or vehicles that can cause death.
5. Cold weather and heat related injuries and illness including but not limited to frostnip, frostbite, heat exhaustion, heat stroke, sunburn, hypothermia and dehydration.
6. Exposure to outdoor elements, including but not limited to avalanche, rock fall, inclement weather, thunder and lightning, severe and/or varied wind, temperature and all other weather conditions.
7. Attack by or encounter with insects, reptiles, and/or animals.
8. Accidents or illness occurring in remote places where there are no available medical facilities.
9. Fatigue, chill, and/or dizziness, which may diminish my/our reaction time and increase the risk of accident.
10. My sense of balance, physical coordination, and ability to follow instructions.
11. Risk of camping/sitting in a blind, to include but not limited to fire, burns, cuts, sun exposure, poisonous plants, insects, food safety, carbon monoxide poisoning, and wild animals.
12. Food poisoning or any illness related to the food being served.
13. Operating a vessel or vehicle while under the influence of alcohol and or drugs.
14. The potential risk of slips, trips, and falls while hiking and getting in and out of any type of building or vessel.
15. During the tournament a lifejacket must be worn while in a vessel.
* I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. Release of Liability, Waiver of Claims and Indemnity Agreement In consideration for being permitted to participate in any way in hunting/fishing and related activities, I hereby agree, acknowledge and appreciate that:
1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named person or entities, herein referred to as releasees: Brothers-Sisters Of Our Military Adventures & Randall County Sheriffs Association.
2. To release the releasees, their officers, directors, volunteers, representatives, agents, sponsors to include landowners, and vessels from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releasees or otherwise. By executing this document, I agree to hold the releasees harmless and indemnify them in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.
3. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this agreement. This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforceable. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF PARTICIPATION)
This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these events and activities and/or the use of related real and personal property as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE.
Tournament Rules
Maximum of 4 people per boat. Solo OR Teams of 2.
1. Artificial Lures Only
2. No Drinking while operating a vessel!
3. On water @ 0500. Fishing starts @ Safe Light.
4. Weigh in last boat @ 1530.
5. Five Fish Limit. Dead/Undersized Disqualify.
6. Boat live wells with working circulation systems.
7. Use proper fish handling techniques to reduce fish stress.
8. Limit time in bags from boat to weigh-in to five (5) minutes.
9. ALL LAKE, LOCAL, & STATE LAWS WILL BE ADHERED TO!
Vehicles and boat trailers should be parked in a manner to prevent congestion and to keep launching facilities open.
All participants must follow Texas Administrative Code, Lake Meredith NRA, State fishing laws, rules and requirements.
Participants shall comply with all Federal and State fishing and boating regulations while within Lake Meredith National Recreation Area.
Five miles per hour boat speed must be observed in marked harbors (“no wake” buoys mark harbor limits).
To help prevent the spread of aquatic invasive species
All participants must follow Texas Administrative Code; Title 31 Part 2 Chapter 57 Subchapter N Division.
All vessels approaching public fresh water in Texas should be clean, drained and dry.
The following are required by Lake Meredith NRA and Texas Administrative Code; Draining of Water from Vessels Leaving or Approaching Public Fresh Water:
• All water other than water in a live well must be drained from the vessel prior to weigh-in
• The live well must be transported by the most direct route to an official weigh-in location designated by the tournament director and documented on the NPS permit;
• The water in the live well must be drained or properly disposed of before the vessel leaves the weigh-in location
• Participants in possession of water in the live well must possess documentation provided by the fishing tournament representative that bears the participant's name, the date, water body name, tournament name, location and time of the weigh-in, and the name and phone number of a tournament representative.
