TOUR OF MINNESOTA RELEASE OF LIABILITY WAIVER 2025 PARTICIPATION, ACKNOWLEDGEMENT OF RISK, WAIVER OF LIABILITY, INDEMNIFICATION AGREEMENT, AND CANCELLATION POLICY
1. I choose to participate voluntarily as a Rider and/or Crew member in the Tour of Minnesota Bicycle Ride as a participant. My participation in the Tour of Minnesota is my own idea and is of my own free will without any compulsion whatsoever.
2. I understand that the Tour of Minnesota is a non-competitive, long-distance bicycle ride. I understand that the Tour of Minnesota will involve extensive travel by bicycle and additional related events, including but not limited to training rides. I recognize that participation as a Rider and/or Crew member in a long-distance bike ride is very dangerous and involves the risk of serious injury and/or death and/or potentially extensive medical and rescue expenses. I further recognize that the bicycle trip may be a long way from hospitals, doctors, and pain-relieving medicines. I may encounter bad roads, trails or bad weather, which the Tour of Minnesota has no control over. I represent that I have experience in lengthy biking trips so as to be adequately prepared to engage in a bike ride of this nature. I represent that I am in good health to allow me to take part in this bike ride as a Rider and/or Crew member. I also agree that I am solely responsible for my compliance with all traffic laws regardless of the conduct of other riders.
3. As consideration for being permitted to participate in the Tour of Minnesota, I hereby, for myself, my heirs, administrators, personal representatives and assigns, forever release and discharge the Tour of Minnesota, Do-B Events, LLC, and each of their owners, members, shareholders, directors, officers, governors, managers, employees, agents, representatives, and volunteers (the “Released Parties”) of and for any and all injuries and damages arising out of my participation as a Rider and/or Crew member in the Tour of Minnesota, whether caused by any act, omission, or negligence of the Released Parties or otherwise. This release will not apply to injuries or damage directly caused by any willful, wanton, or reckless act of any of the Released Parties.
4. I acknowledge that the Released Parties have never expressly or impliedly assumed any responsibility for me as a Rider and/or Crew member during the Tour of Minnesota or for any other activity connected to my participation in the Tour of Minnesota. I hereby personally assume all risks in connection with my participation in the Tour of Minnesota and all activities connected with the Tour of Minnesota directly or indirectly. To that end, I agree to obtain comprehensive medical insurance and to pay the full cost thereunder to cover all potential risks of my participation in this event.
5. I acknowledge that I alone am responsible for my personal safety, the condition of the bicycle that I will be riding, the condition of any other equipment that I will be using, and all personal property that I bring with me. I understand that I am solely responsible for my bicycle, equipment, and personal property, which means that none of the Released Parties will be responsible for the safekeeping or custody of any such property. I hereby for myself, my heirs, administrators, personal representatives and assigns, indemnify, defend, and agree to hold the Release Parties harmless for any cost, expense, liability, or loss of any nature or description (including reasonable attorney’s fees) arising from injury to person or damage to property sustained as a result of any of my acts or omissions.
6. In addition to the above risks, participation in the Tour of Minnesota includes possible exposure to and illness from infectious diseases including, but not limited to, MRSA, influenza, and COVID-19 (collectively “Infectious Disease Risk”). Each participant, by signing below represents that he/she will withdraw from participating if he/she has any symptoms of COVID-19 or other infectious diseases, including without limitation, fever, cough, or shortness of breath, or has had exposure to COVID-19 or other infectious diseases within the last fourteen (14) days, which includes travel from highly impacted regions designated by the CDC or exposure to any person returning from highly impacted areas. Each participant, by signing below, agrees that he/she will avoid contact with other participants, will maintain social distancing and will follow the Minnesota Department of Health and the CDC guidelines. I knowingly and freely assume all such risks both known and unknown arising from my exposure to any and all infectious disease risks, and I assume full responsibility for my participation.
7. Because bicycle riding is dangerous, I agree to always ride safely. I also agree to wear a helmet certified by ANSI, Snell, CPSC, or ASTM, whether during the ride itself or on training rides. I also agree to refrain from headphones or earphones and from playing music when participating in the event.
8. I understand and recognize that I am not, nor have I ever been, an agent of the Released Parties in connection with this activity and that none of the activities connected with the Tour of Minnesota, constitute a joint venture or enterprise of any type with the Released Parties. I agree not to represent myself to third parties as an employee or agent of the Released Parties.
9. I understand and agree to the use of my name, photograph, voice or likeness by the Released Parties, their licensees, affiliates and employees. I consent to and authorize in advance such use and waive my right to privacy I have in connection therewith.
10. I have carefully read the above release and agreement prior to its execution, and I am fully familiar with the contents thereof. I agree that this release and agreement will be governed by Minnesota law and is intended to be as broad and inclusive as permitted by the law of Minnesota and that if any portion of it is held invalid, the balance shall continue in full legal force and effect. This release shall be binding upon myself, my heirs, administrators, personal representatives and assigns, forever.
I UNDERSTAND THAT THIS IS AN IMPORTANT LEGAL DOCUMENT. BY AGREEING TO IT, I REPRESENT THAT I HAVE READ THIS DOCUMENT CAREFULLY AND IN FULL, THAT I AGREE TO ALL OF ITS PROVISIONS, AND THAT I AGREE TO IT OF MY OWN FREE WILL. I HEREBY WARRANT THAT I AM AT LEAST 18 YEARS OF AGE AND HAVE THE RIGHT TO CONTRACT IN MY OWN NAME.
IF THE RIDER IS UNDER THE AGE OF 18 AT THE TIME OF AGREEING TO THIS DOCUMENT, HIS OR HER PARENT OR LEGAL GUARDIAN MUST AGREE TO THIS FORM ON HIS/HER BEHALF AND ALSO BE PRESENT WITH THE PARTICIPANT DURING THE ENTIRE EVENT. AS SUCH PARENT OR GUARDIAN, I AGREE THAT THE TERMS OF THIS DOCUMENT SHALL APPLY TO SUCH MINOR AND THAT I AM AGREEING TO THIS ON HIS/HER BEHALF AND THAT I PERSONALLY GUARANTEE THAT I HAVE THE LEGAL RIGHT TO DO SO AND THEREBY BIND THE MINOR, HIS/HER HEIRS, ADMINISTRATORS, PERSONAL REPRESENTATIVES AND ASSIGNS, FOREVER.
11. CANCELLATION POLICY: I understand that the costs of planning and operating the Tour of Minnesota Bicycle Ride are fixed and do not change because of cancellations by participants. As a result, I understand that registration fees are completely non-refundable regardless of whether I decide to withdraw from the event.
I hereby warrant that I am at least 18 years of age and have the right to contract in my own name.
