In consideration of the acceptance of my entry I, for myself, my heirs, for whom I am guardian of, executors and administrators, do hereby discharge and release Hearts With A Mission, the City of Medford, Gold Hill and Grants Pass, Jackson, Josephine County, State of Oregon, and all cooperating businesses, officials, sponsors, producers, volunteers, supporters, organizations, assigns and/or their representatives (“Releasees”) of all claims, damages, actions, liabilities, costs and/or expenses whatsoever, which I may have against them in any way connected with my participation in this event, including travel to or from this event and including death, personal injuries, and/or property damage which may be suffered by me before, during or after the event. I authorize the officials of the race to use their discretion to have me or my child transported to a medical facility and I take full financial and legal responsibility for this action. I verify that I am physically fit enough to compete in this event and that I am medically cleared to participate by my physician.
THIS RELEASE, WAIVER AND COVENANT NOT TO SUE IS INTENDED TO DISCHARGE IN ADVANCE THE RELEASEES FROM AND AGAINST ANY AND ALL LIABILITY ARISING OUT OF, OR CONNECTED IN ANY WAY WITH PARTICIPATION BY THE UNDERSIGNED IN THE ABOVE-DESCRIBED EVENT, EVEN THOUGH THAT LIABILITY MAY ARISE OUT OF NEGLIGENCE, CARELESSNESS OR OTHER CONDUCT ON THE PART OF SPONSORS.
I EXPRESSLY AGREE THAT THE FOREGOING RELEASE, WAIVER AND COVENANT NOT TO SUE IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAWS OF THE STATE IN WHICH THE EVENT IS CONDUCTED AND THAT IF ANY PORTION THEREOF IS HELD INVALID, IT IS AGREED THAT THE BALANCE SHALL, NOTWITHSTANDING, CONTINUE IN FULL LEGAL FORCE AND EFFECT.
I AGREE THAT NO PROMISE OR INDUCEMENT HAS BEEN OFFERED EXCEPT AS HEREIN SET FORTH, AND THAT THIS RELEASE, WAIVER AND COVENANT NOT TO SUE HAS NOT BEEN EXECUTED BASED UPON STATEMENTS OR REPRESENTATIONS BY ANY PERSON OR ENTITY OTHER THAN THOSE SET FORTH HEREIN.
I permit the use of my name, photograph and/or recording to be used in connection with this event for any lawful purpose. In the event of extreme weather conditions, Hearts With A Mission reserves the right to cancel the race without advance notice and as advised by law enforcement and Fire-Rescue. If this should be necessary, entry fees may be carried out to the next race event. The final decision regarding cancellation of the race will be made 15 minutes prior to the scheduled start time and will be announced over the race public address system.
