WARNING: READ THIS EVENT WAIVER AND RELEASE OF LIABILITY AGREEMENT (THE "AGREEMENT") CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS. BE AWARE THAT BY EXECUTING THIS AGREEMENT AND PARTICIPATING IN THIS EVENT, YOU WILL BE EXPRESSLY ASSUMING THE RISK AND LEGAL LIABILITY, AND WAIVING AND RELEASING ANY CLAIMS FOR INJURIES, DAMAGES, OR LOSS WHICH YOU MIGHT SUSTAIN AS A RESULT OF ANY ACTIVITIES CONNECTED WITH PARTICIPATION IN THE EVENT. Warning of Risks and Assumption of Risks. Participation in the Event may challenge and engage your physical and mental resources. You should not participate in the Event if you have any health conditions affecting your ability to participate. You should seek advice from your physician before participating in the Event. There is always a risk of injury when participating in exercise activities and, understandably, not all hazards and dangers can be foreseen. Participation in the Event may involve inherent risks, dangers and hazards, which may occur without warning, or be due to poor skill level, lack of conditioning, carelessness and other unforeseen, unidentified or unexpected perils inherent in physical activities. By execution of this Agreement, I acknowledge that I understand the risk and danger of accidents, physical injury, effects of exercise, and the unpredictable nature of the human body and the activities inherent in the nature of the Event. I acknowledge that I am a voluntary participant in this Event, and in good physical condition. I further acknowledge that physical exercise and participation in this Event will challenge and engage my physical resources. I have either visited with my physician and received doctor's advice and consent to my exercise program or have waived such advice and consent of my doctor, and accept any and all risks.
Waiver, Release and Indemnification.
I UNDERSTAND AND ACKNOWLEDGE THAT NEITHER THE SPONSOR OR ANY OF ITS AFFILIATES ARE INSURERS OF MY CONDUCT AND SAFETY. I KNOW THAT THIS EVENT IS A POTENTIALLY HAZARDOUS ACTIVITY AND I HEREBY ASSUME FULL AND COMPLETE RESPONSIBILITY FOR ANY INJURY OR ACCIDENT WHICH MAY OCCUR DURING MY PARTICIPATION IN THIS EVENT. TO THE FULLEST EXTENT PERMITTED BY LAW, I HEREBY RELEASE, WAIVE, HOLD HARMLESS AND COVENANT NOT TO FILE SUIT AGAINST THIS EVENT, THE SPONSOR AND ANY AFFILIATED INDIVIDUALS OR ENTITIES ASSOCIATED WITH THIS EVENT (INCLUDING ALL TRUSTEES, DIRECTORS, MANAGERS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS AND REPRESENTATIVES OF THE SPONSOR) (THE "RELEASEES") FROM ANY AND ALL LOSSES, DAMAGES, LIABILITIES OR OTHER CLAIMS AND CAUSES OF ACTION WHATSOEVER THAT I MAY HAVE ARISING OUT OF MY PARTICIPATION IN THIS EVENT, INCLUDING PERSONAL INJURY, DEATH OR DAMAGE SUFFERED BY ME, MY PERSONAL PROPERTY OR OTHERS, WHETHER THE SAME BE CAUSED BY FALLS, CONTACT WITH OTHER PARTICIPANTS, CONDITIONS OF THE COURSE, NEGLIGENCE OF THE RELEASEES OR OTHERWISE. I AGREE THAT, IN THE EVENT ANY PERSON BRINGS ANY CLAIM OR ACTION INDIVIDUALLY OR ON MY BEHALF, RELATED TO ANY INJURY OR LOSS SUFFERED BY ME AS A RESULT OF MY PARTICIPATION IN THE EVENT, THAT I WILL INDEMNIFY THE RELEASEES AGAINST SUCH CLAIMS, INCLUDING THE PAYMENT OF ATTORNEY FEES. I AGREE THAT THIS AGREEMENT SHALL BIND MY GUARDIAN, ASSIGNS, HEIRS, ADMINISTRATORS AND EXECUTORS FOREVER.
I understand that this Waiver and Release may be stored electronically and agree that a copy is authentic and admissible as evidence in any future dispute or proceedings.
If I do not follow all the rules of this Event, I understand that I may be removed from the Event. I give my full permission to this event and their sponsors and corporate sponsors to use any photographs, videotapes or other recordings of me that are made during the course of this Event.
AGREEMENT AND WAIVER (if registering a child 17 years or younger):
I understand that my child/children’s active participation in physical activity could result in injuries that may include but are not limited to strains, sprains, breaks, loss of eyesight, concussions, partial or total paralysis and even death. Each child and his/her parents/guardians assume these risks by allowing the child to participate in club activities. In acceptance of entry, I for my child/children, my heirs and assigns, release the Grove City Athletics Club (GCAC), GCAC board of directors, GCAC coaches, all other sponsors, coaches, and volunteers from any and all liability arising from illness, injury or damages that my child/children may suffer as a result of my child/children’s participation in, traveling to, or traveling from club activities. I also give my permission to copyright, use, re-use and publish videos, photographic portraits, pictures for any photographs in which my child/children or his/her name(s) may be included through any social media or website postings, media for art, race/training results/photos, advertising, trade, recruitment, print media, or any other purposes. Children/youth MUST follow all GCAC rules, school/facility rules, safety guidelines, and instruction as introduced by the GCAC coaches or volunteers. GCAC participants consistently failing to follow safety policies will be dismissed from the club. I choose to allow my child/children to participate in club activities by my own free will and accept all elements of risk involved. I realize that club activities include strenuous exercise that requires proper physical conditioning. I hereby certify that my child/children is in such physical condition and good health. I assume the risks for my child/children of this club and its activities.
GCAC STATEMENT OF AGREEMENT AND WAIVER:

I realize that club activities include strenuous exercise that requires proper physical conditioning. I hereby certify that I am in such good physical condition and good health. I assume all risks of this club and its activities.
IMPORTANT COVID-19/PANDEMIC DISCLAIMER INFORMATION:
No one knows what the future of elementary/youth sports and fitness holds. Security at mass sporting events changed with 9/11 and with the Boston Bombing incident. We have learned to deal with and respect that. Now with the advent of Coronavirus (COVID-19) we anticipate that elementary/youth sports and fitness activities will not return to pre-2021 standards for quite some time. This too, must be dealt with and respected.
We aim to provide enjoyable, healthy, and safe programs. However, when dealing with people (especially kids) and with a global pandemic, it is challenging. Anyone registering for and attending our events (or your child attending) must realize that he or she must be held accountable for his or her actions and reactions. The Grove City Athletics Club must also be responsible and abide by restrictions set by our club, coaches, community, and government.
By continuing yourself or permitting your child to continue in Grove City Athletics Club programs, you acknowledge the health/safety risks outlined during registration AND for you and your child possibly contracting COVID-19, which can result in severe illness and death. COVID-19 is a communicable disease and can also spread easily to others should you or your child become infected. More info here: https://www.cdc.gov/coronavirus . I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html . In addition, I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume the risk that I may be exposed to or infected by COVID-19 and/or other communicable diseases by participating in any activities associate with the club. I acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 in connection with my or my household member's participation in any club activities, and personally assume this risk.
If you feel that the health risk of you or your child attending any of our programs/events is greater than the anticipated benefit, we request that you do not register or attend the program/event. If state mandated guidelines change before or during any of our programs to the extent that they must be cancelled, your entry and processing fees will not be refunded. We have club expenses coming into our programs and it must be realized that it is a risk that you must take when registering you or your child.
Participants will be required to follow safety protocols set forth by the volunteer coaching staff, including but not limited to non-contact forehead infrared thermometer checks, using hand sanitizer, wearing masks when directed, etc. The Grove City Athletics Club also reserves the right to limit numbers at practices, change practice dates/times, or cancel programs with no full or partial refunds.
Unfortunately due to COVID-19 restrictions, we had to limit participants within our elementary programs in 2020. Since 2012 (previously called the “Grove City Running Club”), we have never had to do this, but it was for the safety of you and our children. The last thing we want to do is cancel, but please be cognizant that some things just may be out of our control. Thank you!
