General Consent & Liability Wavier
I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the City and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, my child, or my guest in, on, or about the premises, or as a result of the use or participation in any of the following: trips, programs, games, sports practice or training, outdoor activity, youth sports program, special events, equipment, facilities, classes, or programs, regardless of whether such injuries result, in whole or in part, from the negligence of the City of Newport.
By the execution of this release, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me, my child or my guest, and I hereby fully and forever release and discharge the City, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment, facilities, programs, or classes.
I expressly agree to indemnify and hold the City of Newport harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me, my child, or my guest.
I agree to be solely responsible for safety and wellbeing of my guest, my child, and myself. I understand that the City does not provide supervision, instruction, or assistance for the use of the facilities, classes, programs, activities, and equipment.
I also understand the City of Newport conducts no medical examination or inquiry concerning my physical or mental condition and it is solely up to me, in consultation with my physician or other health care provider, as to whether or not to participate in any program, class, event, or use of any equipment or facility or for my child’s participation in any program, class, event, trip, or use of any equipment or facility.
I agree to comply with all rules imposed by the City of Newport regarding the use of the facilities, classes, programs, and equipment, including the Newport Parks and Recreation Code of Conduct. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.
I understand and acknowledge that the use of exercise equipment and/or participation in programs, classes, activities, trips, outdoor activities, sports programs, practice or training, involves risk of serious injury, including permanent disability and death.
I understand and agree that the City of Newport is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.
CONSENT OF PARENT/GUARDIAN (If Participant is a minor)
I am the parent or legal guardian of the participant listed above. I hereby consent that the participant may participate in activities at this, or any other City of Newport Parks and Recreation facility and I hereby execute the Agreement, Waiver and Release on his/her behalf. I hereby affirmatively state that the said Participant is physically able to participate in said activity. I hereby agree to indemnify and hold the persons and entities mentioned above free and harmless from any loss, liability, damage, cost or expense that they may incur as result of the death or any injury or property damage that said participant may sustain while participating in activities at any such City of Newport Parks and Recreation Department facility.
I HAVE CAREFULLY READ BOTH FRONT AND BACK OF THIS AGREEMENT, WAIVER AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE CITY OF NEWPORT AND I SIGN IT OF MY OWN FREE WILL.
CONSENT TO USE PHOTOGRAPHS AND NAME
I allow the City of Newport to use mine or my child’s, name and/or photograph in activity materials, publications, social media, and/or web pages without compensation.
