RELEASE AND WAIVER STATEMENT

The undersigned understands and acknowledges that running or walking a five kilometer race or kids run (“Water Drop 5k”/ “Water Droplet Kids Run”) entails some level of risk and that such risk could potentially lead to property damage, personal injury, and/or death. The undersigned is making an informed decision that the benefits of participating in the Water Drop 5k/Water Droplet Kids Run outweighs the risks and is voluntarily incurring such risks both for the undersigned and for minors, wards, or others who may be under the undersigned’s supervision.

The undersigned, on behalf of the undersigned and on behalf of any minor, ward, or other person for whom the undersigned is a parent, legal guardian, or exercising a duty of supervision, and on behalf of heirs, representatives and assigns of the foregoing does hereby release, discharge, hold harmless, agree to indemnify, and forever acquit the Wabash River Enhancement Corporation, the City of West Lafayette, the West Lafayette Parks Department, and other participating organization members, officers, and volunteers (hereinafter “the released parties”) from any and all actions, causes of action, claims or any liabilities whatsoever, known or unknown now existing or which may arise in the future on account of or in any way related to or arising out of the undersigned’s participation or the participation of minors, wards, or others who might be under the undersigned’s supervision in events associated with the Water Drop 5k/Water Droplet Kids Run, including, without limitation, actions, causes of action, claims or any liabilities arising out of claims that the released parties were negligent. The undersigned further understands that this waiver is being relied upon as a material inducement for the released parties to allow the undersigned’s participation in the Water Drop 5k/Water Droplet Kids Run activities.

The Released Parties assume no risk of injury to the undersigned or any minor, ward, or other person for whom the undersigned is a parent, legal guardian, or exercising a duty of supervision. The undersigned further understands and agrees that the Released Parties will not be providing supervision for any minor, ward, or other person for whom the undersigned is a parent, legal guardian, or exercising a duty of supervision and that the health, safety, and supervision of such individuals shall be the responsibility of the undersigned.

My signature below indicates that I have read, understand, and agree to the above terms and am aware that by signing this form I am giving up substantial rights both for myself and for any minor children for whom I am responsible.
