ASSUMPTION OF RISK, RELEASE, WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT


The University of Nebraska at Omaha (“UNO”) strives to provide a safe environment for its Chesterman Coca-Cola Maverick Run Participants (“Participant”). However, it is important for the Participants, and their parent or legal guardian if the Participant is under 18, to understand that even with safety measures, participation in Chesterman Coca-Cola Maverick Run involves unavoidable exposure to an inherent risk of injury.

Therefore, the individual named below as “Chesterman Coca-Cola Maverick Run Participant” or Participant’s parent or legal guardian, if applicable, agrees and authorizes the Participant to participate in the Chesterman Coca-Cola Maverick Run and associated activities (the “Activity”). The Activity will consist of running or walking in a 10K or 5K run, a 5K walk, or 1-mile kids’ race and interactive inflatables.

Participant or Participant’s parent or legal guardian assumes all risks associated with being a participant in the Activity which may include but is not limited to: falls, physical contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators including the potential for contraction of a communicable disease resulting from contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators. Participant or Participant’s parent or legal guardian assumes all risks including: the effects of the weather; high heat and/or humidity; freezing cold temperatures; traffic; and the conditions of the roads, sidewalks, paths and trails including surrounding terrain. Participant or Participant’s parent or legal guardian assumes all such risks being known, appreciated, and accepted by the Participant, including permanent disability or death, or property damage associated with participation in the Activity.

The person signing this document understands that it is Participant or Participant’s parent or legal guardian’s responsibility to consult a physician and to take into account Participant’s personal health and physical condition prior to Participant’s participation in the Activity. The person signing this document further represents that they have thoroughly explained to any minor Participant(s) the risks associated with participating in the Activity using language appropriate to the age and intellectual capacity of the Participant.

Participant or Participant’s parent or legal guardian on behalf of Participant RELEASES and covenants not-to-sue the Board of Regents of the University of Nebraska, or its trustees, officers, employees or agents for any and all present and future claims resulting from ordinary negligence on the part of the University of Nebraska. The undersigned voluntarily waives any and all claims or actions resulting from ordinary negligence, both present and future, that may be made by Participant’s family, estate, personal representative, heirs, or assigns.

SEVERABILITY AND GOVERNING LAW

The undersigned agrees that this Agreement is intended to be interpreted as broadly and inclusively as is permitted by the law of the State of Nebraska and that if any portion of the Agreement is held invalid, it is agreed that the remaining portions shall continue in full legal force and effect. The undersigned agrees that this Agreement shall be construed in accordance with the laws of the State of Nebraska and that any action brought against the Board of Regents of the University of Nebraska, or its trustees, officers, employees or agents shall be brought in a forum within the State of Nebraska having jurisdiction over the matter. Nothing in this Agreement shall be interpreted to constitute a waiver of the University of Nebraska’s sovereign immunity.

PHOTO RELEASE

Participant or Participant’s parent or legal guardian grants to the Board of Regents of the University of Nebraska (“University”) and press and media admitted to the Activity by the University the right to photograph, videotape or otherwise digitally collect Participant’s name, likeness, voice and sounds (as “Works”) during participation in the Activity. Participant or Participant’s parent or legal guardian further irrevocably grants to the University all rights in these Works and the right to use or sublicense these Works and Participant’s name, likeness and biography, in the University’s discretion, in all media and in all forms or purposes, including without limitation, advertising and other promotions for the University, without any further consideration to Participant or Participant’s heirs, assigns, legal and personal representative(s).

Due to the 5k courses being on Omaha City Streets there will be a time limit set for course completion. The Omaha Police Department will re-open the streets along the 5K course at 10:45 a.m. Any runners or walkers left on the course will be asked to move to the sidewalks.
