Event Waiver and Release of Liability

WARNING: READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO SUE THIS EVENT AND OTHER PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.

I understand that my consent to these provisions is given in consideration of the acceptance of this registration and for being permitted to participate in this event. I am a voluntary participant in this event, and in good physical condition. I have been advised that I should seek advice from my physician before undertaking this physical exercise. I have either visited with my physician and received doctor's advice and consent to my exercise program or have waived such advice and consent of my doctor, and except any and all risks.

I KNOW THAT THIS EVENT IS A POTENTIALLY HAZARDOUS ACTIVITY AND I HEREBY ASSUME FULL AND COMPLETE RESPONSIBILITY FOR ANY INJURY OR ACCIDENT WHICH MAY OCCUR DURING MY PARTICIPATION IN THIS EVENT OR WHILE ON THE PREMISES OF THIS EVENT, AND I HEREBY RELEASE AND HOLD HARMLESS AND COVENANT NOT TO FILE SUIT AGAINST THIS EVENT AND ANY AFFILIATED INDIVIDUALS OR ENTITIES ASSOCIATED WITH THIS EVENT (THE RELEASEES) FROM ANY LOSS, LIABILITY OR CLAIMS I MAY HAVE ARISING OUT OF MY PARTICIPATION IN THIS EVENT, INCLUDING PERSONAL INJURY OR DAMAGE SUFFERED BY ME OR OTHERS, WHETHER SAME BE CAUSED BY FALLS, CONTACT WITH PARTICIPANTS, CONDITIONS OF THE COURSE, NEGLIGENCE OF THE RELEASEE OR OTHERWISE.

I understand many Club Sports/Intramural activities involve risks of bodily injury, property damage, and other dangers associated with participation in such activities. I understand dangers peculiar to activities normally engaged in include, but are not limited to: Broken bones, cuts-scrapes-sprains, bruises, concussion, heart attack. I understand each participant in Club Sports/Intramural activities should realize that there are risks, hazards, and dangers inherent in such activities and in the training, preparation for and travel to and from activities.

I understand each participant in Club Sports/Intramural activities must be covered by an accident insurance policy. I understand it is the student's responsibility to secure an accident/injury insurance policy because Central Oregon Community College does not provide primary insurance for Club Sports/Intramural participants, and rather, COCC provides catastrophic insurance with an extremely high deductible. I understand the participant is responsible for meeting the deductible.

I understand it is the responsibility of each participant to participate only in those activities for which they have the prerequisite skills, qualifications, preparations, and training. Therefore, in consideration of the benefits received from the Club Sports/Intramural activities I, as the undersigned, and/or parent/guardian, do hereby assumes all risks of damages or injury, including injury which may prove fatal, that may be sustained by them while participating in Club Sport/Intramural programs and activities or in the travel to or from such activities.

I, as the undersigned applicant, and/or parent/guardian, hereby releases Central Oregon Community College, its employees, agents, officers, and directors from any and all claims, demands, cause of action, damage, loss of services, costs and expenses in any way resulting from any and all injury to person or property arising directly or indirectly out of their participation in Club Sport/Intramural activity. I, as the undersigned, and/or parent/guardian, further releases Central Oregon Community College, its employees, agents, officers and directors from all liability for personal injury resulting from the failure of the undersigned, and/or parent/guardian, or other students in the club to obey safety regulations and directions of the group leader, or resulting from the exercise of judgment by the group leader in good faith in response to emergencies and exigencies which occur in this event; provided however, that nothing contained herein shall excuse the person assigned to the event by a member of the staff from the responsibility to act with reasonable care for the safety of the participant during the course of the event appropriate to the circumstances. It is my intention as the undersigned, and/or parent/guardian, that this agreement will be governed by the laws of the State of Oregon. This Assumption of Risk for participation in Central Oregon Community College Sports/Intramurals shall be binding on the heirs, successors and personal representatives of the participant and/or parent/guardian.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.

By submitting this entry, I acknowledge for myself and for anyone I am legally able to acknowledge, as a parent or adult legal guardian for all children under 18 years old, that I have read and understand the information provided in the above release and waiver, including the no refund policy.



6. Other Adults NOT INCLUDED In Above Waiver *
Adults cannot legally sign waivers for other adults. PLEASE WRITE THE FULL NAMES AND AGES OF OTHER ADULTS you are registering and paying for, but who will need to sign a waiver separately. Those adults can sign the paper waiver at the event or email jmotenko@cocc.edu to ask for a waiver for the race.

IF THERE ARE NO OTHER ADULTS, WRITE "NA" for "Not Applicable."
