By registering for and participating in this virtual run the Global Steps 'N Salutes 5K ("the Event"), I acknowledge and agree to the following:
Voluntary Participation & Assumption of Risk
I am voluntarily participating in the Event with full knowledge and understanding of the potential risks, both known and unknown, including but not limited to falls, contact with other participants or animals, effects of weather, traffic conditions, and health complications. I certify that I am physically fit and have not been advised otherwise by a qualified medical professional. I fully accept and assume all such risks and all responsibility for loss, costs, and damages I incur as a result of my participation.
2. Responsibility for Personal Safety
I understand that this is a virtual event, meaning there is no set course, support staff, or on-site medical assistance. I am solely responsible for selecting a safe route and complying with all local laws, traffic regulations, weather conditions, and health guidelines.
Release and Waiver of Liability
In consideration for being permitted to participate, I hereby release, discharge, and covenant not to sue the Green Beret Foundation, its officers, directors, employees, agents, affiliates, sponsors, volunteers, and assigns (collectively, "Releasees") from any and all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations. I further agree to indemnify, defend, and hold harmless the Releasees from any and all liabilities or claims made as a result of my participation, whether caused by the negligence of the Releasees or otherwise.
4. Media Release
I grant permission for my name, photo, or video submitted in connection with the Event to be used for promotional purposes by the organizing entity and the Green Beret Foundation, including but not limited to websites, social media, and marketing materials.
Acknowledgment of Understanding
I have read this waiver and fully understand its terms. I understand that I am giving up substantial rights by signing it and do so freely and voluntarily. I understand that by completing my registration online, checking a box, or otherwise affirming agreement electronically, I am providing my legally binding signature and consent to the terms of this waiver.
Family Participation Waiver and Release of Liability
If any participant being registered is under 18 years of age, this waiver must be read and signed by a parent or legal guardian. By signing below, the undersigned parent or legal guardian acknowledges and agrees to the terms of this release on behalf of their minor child(ren) and consents to their participation in the Event. In addition, by registering and signing on behalf of any other adult family members, the undersigned affirms that they have the authority to do so and agree to the terms of this release on behalf of those individuals as well.
The undersigned agrees to release, indemnify, and hold harmless Green Beret Foundation its officers, employees, agents, affiliates, volunteers, sponsors, and any other parties associated with the Event (“Releasees”) from any and all claims, demands, causes of action, or liabilities of any kind, whether known or unknown, which may arise from or relate to the participation of their minor child(ren) and/or other registered adult family members in the Event—including but not limited to claims arising from the negligence of the Releasees.
This release applies to all participants the undersigned is registering for the Event, including but not limited to their minor child(ren) and any other adult family members, and is intended to be as broad and inclusive as permitted by applicable law.
Arbitration Agreement (Texas Law Applies)
I agree that any disputes, claims, or causes of action related to my participation in the Event—including but not limited to personal injury, property damage, wrongful death, or negligence—will be resolved exclusively through final and binding arbitration. Arbitration will be conducted under the rules of the American Arbitration Association (AAA) and take place in the State of Texas. I further agree that:
The arbitrator will have sole authority to resolve all disputes, including questions about the interpretation, scope, or enforceability of this agreement.
The arbitration will be governed by the Federal Arbitration Act (FAA) and Texas law, without regard to conflict of laws principles.
I waive any right to a jury trial and understand that arbitration limits rights to discovery and appeal compared to court proceedings.
This agreement to arbitrate will remain in effect even after the termination of this waiver and my participation in the Event.
Other Terms
Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect upon the enforceability of the remaining provisions.
By completing my registration, I acknowledge that I have read and agree to the terms of this waiver.
