The Edinboro Triathlon Athlete Waiver – 2022
Acknowledgement, Accident Waiver, and Release from Liability
Please read carefully before signing:
I acknowledge that this athletic event is an extreme test of a person’s physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, water, conditions of athletes, equipment, vehicular traffic, actions of other people including but not limited to participants, volunteers, spectators, coaches, event officials, event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to athletes, but are also present for volunteers.
I certify that I am physically fit, have sufficiently trained for participation in this event, and have not been advised otherwise by a qualified medical person.
I hereby assume all the risks of participating and/or volunteering in the event. I understand that use of headphones during this event is prohibited. I realize that the liability may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them or because of their possible liability without fault.
I acknowledge that this Release from Liability form will be used by the event holder, sponsors, organizers, and municipalities through which the race of which I plan to participate in is held, and that I will govern my actions and responsibilities at said event.
In consideration of my application and permitting me to participate in this event, I hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors, and assigns:
A. Waive, release, and discharge from any and all liability for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event the following entities or persons: The Edinboro Triathlon, the state, counties, townships and boroughs in which this event takes place, their directors, officers, employees, representatives, agents, event holders, event sponsors, and event volunteers;
B. Indemnify and hold harmless the entities of persons mentioned in the above paragraph from any and all liabilities or claims made as a result of participation in this event, whether caused by the negligence of Released Parties (as defined above) or otherwise.
I hereby consent to receive medical treatment which may be deemed advisable in the reasonable judgment of on-site and other personnel in the event of injury, accident, and/or illness during the event, and understand I may be billed as appropriate by the agencies who provide care for me and that these agencies are separate from The Edinboro Triathlon.
COVID-19 ASSUMPTION OF RISK: I acknowledge and understand that the World Health Organization has declared COVID-19 a worldwide pandemic. COVID-19 is extremely contagious and spreads mainly from person-to-person contact. Based on currently available information and clinical expertise, older adults and people of any age who have serious underlying medical conditions may have a higher risk for severe illness from COVID-19. There have been recommended guidelines and preventative measures put in place to reduce the spread of COVID-19; however, the Released Parties (as defined above) CANNOT GUARANTEE that I will not become exposed to or infected with COVID-19. Furthermore, the Events could increase my risk of contracting COVID-19. By signing this Agreement, I acknowledge the extremely contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected with COVID-19 from the Events, and that such exposure or infection may involve the RISK OF SERIOUS INJURY, ILLNESS, PERMANENT DISABILITY AND/OR DEATH. I understand that the risk of becoming exposed to or infected with COVID-19 by my participation in the Events may result from the actions, omissions, or negligence of others and/or myself, including, but not limited to, the Released Parties (as defined above). I hereby expressly assume all such risks and dangers whether presently known or unknown.
This event follows the standard industry policy: All entry fees are non-refundable. The event holders reserve the right to postpone or cancel the event due to circumstances beyond their control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under any circumstances. I understand the event holders reserve the right to change the details of the event without prior notice. I understand that this event does not provide for refunds in the event of a cancellation, and by signing this waiver, I consent that I am not entitled to a refund if the event is cancelled before or during the event, and bib numbers are non-transferable.
I understand that during this event or related activities, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the event holders, producers, sponsor, organizers, and assigns. The Waiver shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
