RELEASE and WAIVER of LIABILITY and INDEMNITY AGREEMENT

I understand that my participation in the Five07 Turkey Day Dash 5K/1 Mile involves a certain degree of risk, including but not limited to, the risk of injury, illness, or death. I acknowledge that I am voluntarily participating in this event and assume all risks associated with my participation.

In consideration of being allowed to participate in the Five07 Turkey Day Dash, I, on behalf of myself, my heirs, executors, administrators, and assigns, do hereby waive, release, and discharge any and all claims for damages, liability, loss, or expense against the event organizers, sponsors, officials, volunteers, and any other individuals or entities associated with the event (collectively, the “Released Parties”).

I also agree to indemnify and hold harmless the Released Parties from any and all claims, damages, liabilities, costs, and expenses (including attorney’s fees) arising from my participation in the event, including any claims brought by third parties.

I acknowledge that I have read and understand this waiver agreement, and that I am signing it voluntarily and with full knowledge of its legal significance. I also certify that I am physically fit and sufficiently trained to participate in the event, and that there are no health-related reasons or problems that would preclude my participation in the event.

This waiver agreement shall be binding on me, my heirs, executors, administrators, and assigns. I acknowledge that this waiver agreement is intended to be as broad and inclusive as permitted by the laws of the State of California, and that if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I have read and voluntarily signed the release and waiver of liability and indemnity agreement, and further agree that no oral representations, statements or inducement apart from the foregoing written agreement have been made.
